Judge narrows copyright claims against Stability AI, allows amended complaint

A federal district judge has agreed with Stability AI and other defendants that class-action plaintiffs failed to show that distributing AI-generated images was a copyright infringement, but said the plaintiffs’ direct copyright allegations could proceed.

“Because there are no allegations that any output from Stable Diffusion was identical to a plaintiff’s work,” claims that defendants violated the Digital Millennium Copyright Act are dismissed, wrote U.S. district court for northern California Judge William Orrick in his Aug. 12 order.
